ORDINANCE #10-181 EFFECTIVE DATE:

AN ORDINANCE TO AMEND THE EMMET COUNTY ZONING ORDINANCE, ADOPTED ON AUGUST 24, 1972, AND EFFECTIVE ON OCTOBER 30, 1972, ALL PURSUANT TO THE PROVISIONS OF PUBLIC ACT 183 OF 1943, AS AMENDED.

THIS EMMET COUNTY BOARD OF COMMISSIONERS, STATE OF MICHIGAN ORDAINS:

SECTION I:

Amend Article XXII, Section 2204, paragraph 3, Outdoor Lighting, of the Emmet County Zoning Ordinance by changing the text to read as follows:

3. OUTDOOR LIGHTING.

All outdoor lighting in Business and Industrial districts, whether for illuminating sites, parking areas, buildings, signs and/or other structures shall be shielded, shaded, designed and /or directed away from all adjacent districts and uses; and further shall not glare upon or interfere with persons and vehicles using public streets. Lighting fixtures are to be of the full cutoff design with horizontally aligned flush-mounted (non-protruding) lens, directing light on-site only, and no more than twenty (20) feet in height.

The Planning Commission may permit taller or require shorter fixtures only when the Commission determines that unique conditions exist and where a waiver would: reduce the number or size of light fixtures; not adversely My impacting neighboring properties and permit fixtures in proportion to height and bulk of nearby buildings and other fixtures. Current standards of the Illuminating Engineering Society (ES) will be used as a guideline for all site lighting decisions of the Emmet County Planning Commission

SECTION II: This ordinance shall become effective the first day following the date of approved by the State of Michigan, the Department designated by the State of Michigan, under Act l83, as amended.
